Questions

Common questions about intellectual property

Ask about your situation
Do I need to register my trade mark?

You can't register copyright (it arises automatically), but trade marks must be registered to have the strongest legal protection. An unregistered trade mark may give you "passing off" rights, but these are harder and more expensive to enforce. Registration with the IPO gives you clear, enforceable rights across the UK.

Someone is using my brand name. What can I do?

If you have a registered trade mark, you have clear grounds to demand they stop and seek damages. If not, you may have a passing off claim, but you'll need to demonstrate goodwill and reputation. A solicitor can assess your position and send a formal cease and desist letter.

Can I patent an idea?

Ideas alone cannot be patented. You need a specific invention that is new, involves an inventive step, and can be made or used in industry. Software and business methods have specific restrictions. A solicitor or patent attorney can advise on patentability and the application process.

What should I do if someone is copying my creative work?

Copyright arises automatically when you create an original work. If someone is reproducing it without permission, you can send a formal takedown notice. A solicitor can draft this and advise on whether a damages claim is worth pursuing, taking into account the likely value at stake.
