Questions

Common questions about employment

Ask about your situation
What is the time limit for an unfair dismissal claim?

Six months less one day from the date your job ended, if you were dismissed on or after 1 October 2026. If you were dismissed before then, the old limit of three months less one day still applies. You must notify ACAS for Early Conciliation before you can make a tribunal claim, and the time spent in conciliation pauses the clock. Miss the deadline and you will very probably lose the right to claim, so act quickly.

How long do I need to have worked there to claim unfair dismissal?

Two years' continuous employment if you are dismissed before 1 January 2027. For dismissals on or after 1 January 2027, it falls to six months. Some dismissals are "automatically unfair" and need no qualifying period at all, such as whistleblowing, pregnancy and asserting a statutory right. A solicitor can tell you which applies to you.

What is a settlement agreement and should I sign one?

A settlement agreement is a legally binding contract where you give up your right to bring employment claims in exchange for an agreed payment. You are legally required to take independent legal advice before signing. Many solicitors offer this at a fixed fee, sometimes covered by your employer.

Are employment solicitors no win no fee?

Many operate on a no win no fee basis for straightforward unfair dismissal and discrimination claims. Some charge hourly rates for complex cases. Super Solicitor shows you which firms confirm no win no fee before you make contact.
