Clinical negligence (sometimes called medical negligence) occurs when a healthcare professional's treatment falls below the standard of a reasonably competent practitioner AND that substandard treatment causes harm. A poor outcome alone is not negligence. Medicine carries inherent risk.
Three years from the date of treatment, or from the date you first knew (or should have known) that the harm was caused by negligence. For children, the three years runs from their 18th birthday. In cases of mental incapacity, time may not run at all.
Many clinical negligence solicitors work on a no win no fee basis, though some require a contribution to disbursements (expert reports, court fees). Be aware that these claims are expensive to investigate, and a specialist solicitor will be honest about costs and prospects before proceeding.
Longer than most legal claims. Straightforward cases can settle in 1 to 2 years; complex claims involving serious injury may take considerably longer. The time is largely spent on obtaining and reviewing expert medical evidence.
