About this area

What professional negligence solicitors do

If a solicitor, surveyor, accountant, architect or financial adviser has got it wrong and it has cost you money, you may have a claim against them. These cases turn on what a reasonably competent professional would have done, not on whether the outcome disappointed you. Super Solicitor matches you with an SRA-regulated solicitor who brings claims against professionals.

Common problems they help with

Questions

Common questions about professional negligence

Ask about your situation
How long do I have to bring a claim?

Usually six years from the negligent act, or three years from when you first knew enough to realise you had a claim, with a fifteen year long stop. Limitation in these cases is genuinely complicated and often the first thing the other side argues about, so get advice as soon as you suspect a problem.

Do I have to complain to them first?

Not legally, but there is a pre-action protocol that expects the professional to be told and given a chance to respond before proceedings. For solicitors there is also the Legal Ombudsman, which is free and suits smaller complaints about service. Ombudsman schemes and negligence claims are different routes with different limits.

What can I recover?

The financial loss caused by the negligence, which means the difference between where you are and where you would have been if the work had been done properly. That is not always the same as what you paid them, and it can be a great deal more.

Will I be suing an individual?

In practice you are claiming against their professional indemnity insurance, which regulated professionals are required to hold. That is why these claims are usually defended firmly, and also why a successful claim is usually paid.
