Questions

Common questions about education law

Ask about your situation
Can I challenge a permanent school exclusion?

Yes. Parents can request a review by the school's governing body and, if unsuccessful, apply to an Independent Review Panel. A solicitor can help you prepare your case, challenge the procedural fairness of the exclusion, and represent your child's interests throughout.

What are my rights if my child's SEN needs aren't being met?

If your child has an Education, Health and Care (EHC) Plan, the local authority is legally obliged to provide the support it specifies. If they're not, you can appeal to the SEND Tribunal. A solicitor experienced in SEN law can help you challenge inadequate provision.

Can I appeal a school admissions decision?

Yes. If your child is refused a place at your preferred school, you have the right to appeal to an independent panel. Grounds can include that the school didn't apply its admission criteria correctly, or that the prejudice to your child outweighs any prejudice to the school.

Can I take legal action against a university?

Yes, in certain circumstances, particularly if the university has failed to follow its own procedures, breached a contractual obligation, or discriminated against you. The Office of the Independent Adjudicator (OIA) should usually be exhausted first. A solicitor can advise on whether legal action is appropriate.
