Questions

Common questions about dispute resolution

Ask about your situation
Do I have to go to court to resolve a dispute?

No. Mediation, arbitration, and negotiation resolve the majority of civil disputes without litigation. Courts actively encourage parties to explore alternative dispute resolution (ADR) and may penalise those who unreasonably refuse to engage with it.

What is the small claims court and is it suitable for me?

The small claims track handles disputes up to £10,000 (or £1,000 for personal injury). It is designed to be used without a solicitor, costs are limited, and hearings are informal. For disputes above this threshold, or involving complex issues, legal representation is advisable.

How long does civil litigation take?

It varies significantly. Simple money claims can be resolved in months; complex multi-party disputes can take years. Mediation or negotiation is almost always faster. A solicitor can give you a realistic timeline for your specific dispute.

What if I win but the other party won't pay?

Winning a judgment is not the same as getting paid. If the other party doesn't pay voluntarily, you may need to enforce the judgment, through attachment of earnings, a charging order, or instructing High Court Enforcement Officers. A solicitor can advise on enforcement options.
